In Massachusetts, grandparent visitation does not need to be addressed during divorce. In fact, grandparents may petition the Probate and Family Court for grandchild visitation rights at any time after a divorce. Moreover, this petition can be filed jointly with the non-custodial parent, or independently — as is often the case where the grandparents' own child (the mother or father of the child in question) has died.
However, because the statute enacted by our legislature does not specifically outline the factors required for a grant of third-party visitation rights — many grandparents face an uphill battle if the custodial parent wants to keep them out of a grandchild's life.
